Welcome to MarqetDataLabs. By accessing or using our platform at marqetdatalabs.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service

MarqetDataLabs provides financial data analytics, options intelligence, Monte Carlo simulations, technical indicators, and AI-generated market commentary for exchange-traded funds (ETFs). The Service is available via web browser at marqetdatalabs.com.

2. Not Financial Advice

MarqetDataLabs provides data and analytics for educational and informational purposes only. Nothing on this platform constitutes investment advice, a recommendation, or a solicitation to buy or sell any security. You should always consult a qualified financial advisor before making investment decisions. Past performance does not guarantee future results. Options trading involves significant risk and is not suitable for all investors.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate information and to update it as necessary. You must be at least 18 years old to create an account.

4. Subscription Tiers

MarqetDataLabs offers the following tiers:

• Free: Access to select ETFs (SPY, QQQ, IWM) with limited analytics.
• Pro ($12.99/month or $99/year): Access to all 20+ ETFs, full options chains, Greeks, AI briefings, and advanced analytics.

Pro subscriptions are billed through Stripe. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.

5. Data Accuracy

Market data is sourced from third-party providers and may be delayed up to 15 minutes. MarqetDataLabs does not guarantee the accuracy, completeness, or timeliness of any data. AI-generated analysis is produced by large language models and may contain errors, inaccuracies, or hallucinations. You should not rely solely on any data or analysis from MarqetDataLabs for investment decisions.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Scrape, crawl, or use automated tools to extract data from the Service without permission.
• Redistribute, resell, or commercially exploit data from the Service.
• Interfere with the operation of the Service or impose unreasonable load on our infrastructure.
• Share your account credentials with others or allow others to access your account.

7. Account Inactivity

Accounts that remain inactive for 365 consecutive days may be permanently deleted, including all associated data. MarqetDataLabs will make reasonable efforts to notify you via email before deletion. Once deleted, account data cannot be recovered. You may reregister with the same email address after deletion.

8. Intellectual Property

All content, design, code, and branding on MarqetDataLabs is the intellectual property of MarqetDataLabs and its operators. ETF names, ticker symbols, and index names are trademarks of their respective owners and are used for identification purposes only. MarqetDataLabs is not affiliated with, endorsed by, or sponsored by any ETF issuer, index provider, or financial institution.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Limitation of Liability

To the maximum extent permitted by law, MarqetDataLabs and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses, arising from your use of or inability to use the Service. The Service is provided "as is" and "as available" without warranties of any kind.

11. Indemnification

You agree to indemnify and hold harmless MarqetDataLabs and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications

MarqetDataLabs reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

MarqetDataLabs may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.
